By creating an account, submitting an item or package to Boombinere, requesting a shipment, using the Site or application, or otherwise using the Services, you agree to these Terms of Service. These Terms contain important limitations of liability, claim deadlines, storage rules, binding arbitration provisions, and export-compliance requirements.

1. DEFINITIONS
The following terms have the meanings stated below:
- "Account" means the customer profile used to access the Services, including any assigned suite number and authorized users.
- "Boombinere," "we," "us," or "our" means Boombinere LLC and, where applicable, its employees, contractors, affiliates, agents, branches, and service providers.
- "Business Day" means a day on which the applicable Boombinere warehouse or branch is open for ordinary business, excluding holidays and closures.
- "Carrier" means a postal operator, airline, courier, freight carrier, delivery service, customs broker, or other transportation provider.
- "Customer," "you," or "your" means the individual or entity that creates an Account, uses the Services, owns or controls an Item, or acts through an employee, representative, agent, or authorized user.
- "Declared Value" means the value entered for an Item on a customs declaration, shipping request, invoice, or other shipment record.
- "Destination" means the final country, region, city, address, recipient, end user, or other location identified for delivery.
- "Item" means any commodity, product, document, material, device, component, article, or other property delivered or submitted to Boombinere.
- "Package" means one or more Items received, stored, packed, consolidated, returned, or transported together.
- "Services" means the Site, applications, receiving address, warehouse handling, storage, photography, inspection, repacking, consolidation, returns, purchasing assistance, export preparation, transportation coordination, and other services offered by Boombinere.
- "Shipment" means one or more Packages tendered at one time for transportation from one origin to one Destination.
- "Site" means boombinere.com, its subdomains, and any Boombinere mobile or web application.
- "Warehouse" means a Boombinere receiving, storage, processing, or distribution facility.
2. AGREEMENT TO THE TERMS
These Terms of Service, together with the Privacy Policy, the current Prohibited and Restricted Items Policy, posted rates, service-specific rules, and any written agreement signed by Boombinere, form the entire agreement governing your use of the Services.
You accept these Terms by creating an Account, clicking an acceptance button, delivering or causing an Item to be delivered to Boombinere, submitting a request, paying for or using a Service, or otherwise using the Site or Services. If you do not agree, do not use the Services or send Items to Boombinere.
If you use the Services for a company, organization, or another person, you represent that you have authority to bind that party. References to "you" include that party and its authorized users.
If a signed written agreement conflicts with these Terms, the signed agreement controls only to the extent of the specific conflict. Carrier tariffs, laws, and government orders may override these Terms where legally required.
3. ELIGIBILITY, REGISTRATION, AND ACCOUNT SECURITY
You must be legally capable of entering into a binding contract and must provide complete, accurate, and current registration information. Boombinere may require identity, address, ownership, payment, or business verification at any time.
You must promptly update your name, physical address, email address, telephone number, Destination, and other Account information. Boombinere may rely on information shown in your Account until you update it and the update is accepted.
You are responsible for maintaining the confidentiality of your username, password, authentication methods, and devices. All instructions, charges, declarations, and requests made through your Account are treated as authorized by you unless you notified Boombinere of a compromise before the activity occurred.
You must immediately notify Boombinere of suspected fraud, unauthorized access, a compromised password, or inaccurate Account activity. Boombinere may suspend access or require additional verification to protect the Account or comply with law.
When required for U.S. Postal Service mail or packages, you must provide a properly completed USPS Form 1583 and acceptable identification before Boombinere may receive or forward the mail or Package. Boombinere may return, refuse, or dispose of mail addressed to an unregistered or unverified name as permitted by law.
You may not create multiple Accounts, use another person's identity, allow unauthorized persons to use your suite number, or use the Services to conceal the true purchaser, recipient, beneficial owner, end user, or Destination.
4. CUSTOMER SHIPPING ADDRESS AND INCOMING DELIVERIES
After registration, Boombinere may assign you a U.S. receiving address and unique suite number. You must use the complete assigned address, including the correct suite number and registered recipient name, for every incoming delivery.
Boombinere is not responsible for delays, misrouting, refusal, loss, or additional charges caused by an omitted or incorrect suite number, unregistered name, incorrect address, merchant error, carrier error, or delivery to a location not controlled by Boombinere.
Boombinere does not accept cash-on-delivery, collect-on-delivery, postage-due, freight-due, or similar deliveries unless Boombinere expressly approves the delivery in advance and all required amounts are prepaid. Boombinere may refuse such deliveries in its discretion.
A carrier's tracking record, photograph, or "delivered" scan does not by itself prove that Boombinere received the Package. Deliveries left outside, in an unsecured area, at another address, with an unauthorized person, or outside posted business hours are at the Customer's risk until a Boombinere employee physically takes possession and records receipt.
Boombinere may refuse any incoming Item or Package due to size, weight, condition, odor, leakage, infestation, safety concern, insufficient identification, unpaid charges, account status, suspected fraud, legal restriction, or operational limitation.
5. BEGINNING AND END OF BOOMBINERE CUSTODY
Boombinere's custody begins only when an authorized Boombinere employee physically receives the Item at the correct Warehouse and records or scans it into Boombinere's system. Custody does not begin when a merchant ships the Item, when a carrier marks it delivered, or when it is left outside the Warehouse.
Custody ends when the Item or Shipment is:
- tendered to a Carrier or other authorized service provider for outbound transportation;
- delivered to and accepted by you or your authorized recipient at a Boombinere branch;
- returned, transferred, surrendered, blocked, abandoned, sold, destroyed, or otherwise disposed of in accordance with these Terms or applicable law; or
- released to a government authority, law-enforcement agency, customs authority, or other person legally entitled to possession.
The end of warehouse custody does not eliminate any rights or obligations that expressly survive, including payment, claims, indemnification, export compliance, and limitation-of-liability provisions.
6. OWNERSHIP, MERCHANT TRANSACTIONS, AND ITEM CONDITION
You retain ownership of your Items, subject to Boombinere's contractual and legal rights, including rights to hold Items for unpaid charges, legal compliance, fraud review, safety, and enforcement of any applicable lien.
Boombinere is not the seller, manufacturer, merchant, or guarantor of Items purchased from third parties. Product quality, authenticity, completeness, merchant descriptions, warranties, refunds, recalls, and defects are matters between you and the seller or manufacturer unless Boombinere expressly agrees otherwise in writing.
You are responsible for the Item's condition before it enters Boombinere's custody. A basic check-in, exterior photograph, weight entry, description, or acceptance by Boombinere does not establish that the Item is undamaged, authentic, complete, functional, or suitable for export.
If Boombinere offers purchasing assistance, you authorize Boombinere to place an order based on the information you provide. You remain responsible for product selection, legality, suitability, merchant terms, taxes, restocking fees, return eligibility, and the accuracy of the purchase instructions. Boombinere does not guarantee availability, price, merchant acceptance, or delivery.
7. INSPECTION, VERIFICATION, AND SECURITY
Boombinere may, but is not required to, open, inspect, photograph, measure, weigh, scan, research, test, or otherwise examine any Item or Package without prior notice when reasonably necessary for processing, safety, fraud prevention, carrier compliance, customs compliance, export compliance, insurance administration, or protection of persons and property.
Boombinere's standard receiving process may include exterior photographs and basic identifying information. Unless you request and pay for an available inspection service, Boombinere does not ordinarily open sealed manufacturer packaging, remove protective materials, verify contents hidden from view, test functionality, authenticate products, or document concealed condition.
Boombinere uses reasonable physical and operational security measures, but no warehouse, fence, camera, alarm, employee procedure, or computer system can guarantee that loss, theft, damage, unauthorized access, or interruption will never occur.
You authorize Boombinere to use photographs, dimensions, product specifications, order information, and third-party databases to identify, classify, process, and ship Items. Any description or classification prepared by Boombinere is based on available information and is not a warranty or legal opinion.
8. PROHIBITED, RESTRICTED, AND DANGEROUS GOODS
You may not submit an Item that is illegal, unsafe, prohibited by these Terms, prohibited by a Carrier, or unacceptable under Boombinere's current Prohibited and Restricted Items Policy. The online policy is incorporated into these Terms and may contain more detailed or Destination-specific restrictions.
The following nonexclusive categories are prohibited unless Boombinere gives prior written approval and the transaction is lawful in every relevant jurisdiction:
- firearms, firearm frames or receivers, ammunition, explosives, weapon components, weapon tooling, silencers, scopes or sights designed for weapons, military or tactical equipment, stun devices, pepper spray, restraints, and realistic weapon replicas;
- defense articles, defense services, technical data, military electronics, night-vision equipment, and Items subject to the ITAR or the United States Munitions List;
- illegal drugs, controlled substances, cannabis, CBD or hemp products, drug paraphernalia, smoking devices, and prescription or veterinary medications;
- cash, currency, payment cards, negotiable instruments, money orders, cashier's checks, bank drafts, bearer instruments, lottery tickets, and gambling devices;
- explosives, fireworks, matches, combustible or flammable substances, fuels, paints, oils, certain adhesives, chemicals, poisons, corrosives, radioactive materials, and other hazardous materials;
- aerosols, pressurized cans, compressed gases, hand sanitizer, perfume, and other dangerous goods unless specifically accepted under a written procedure;
- damaged, defective, swollen, recalled, counterfeit, uncertified, or improperly packaged batteries or battery-powered devices; loose lithium-metal batteries and power banks may be prohibited under Boombinere or Carrier policy;
- perishable food, fresh produce, plants, seeds, soil, live animals, biological materials, and products made from protected wildlife or prohibited animal skins;
- alcohol, tobacco, nicotine products, and other age-restricted products;
- pornography, illegal sexual content, counterfeit goods, stolen property, lock-picking devices, covert surveillance or spy devices, and Items intended to violate privacy or other rights;
- government identification documents, licenses, badges, uniforms, patches, or other Items represented as official government issue; and
- any Item that requires a license, permit, registration, authorization, exemption, exception, certificate, or special documentation that Boombinere has not expressly agreed in writing to handle.
Certain Items may be treated as restricted rather than absolutely prohibited, including vitamins, nonprescription health products, smartwatches, fitness bands, GPS devices, jewelry, precious stones, food, cosmetics, electronics, batteries installed in equipment, liquids, magnets, radio-frequency devices, drones, and other Carrier- or Destination-regulated goods. Restricted Items are accepted only at Boombinere's discretion and may require additional documentation, packaging, fees, or customer assumption of risk.
A product's omission from a list does not mean it is accepted. Boombinere may refuse any Item it considers unsuitable, unsafe, unlawful, high risk, operationally impractical, or likely to be rejected, seized, or delayed, even when possession or domestic sale of the Item is legal.
You must disclose all dangerous or regulated contents before delivery and again before requesting shipment. Undeclared dangerous goods may be isolated, returned, surrendered, or disposed of at your expense, and may be reported to a Carrier or government authority.
9. EXPORT CONTROLS, SANCTIONS, AND LICENSE-REQUIRED ITEMS
All Services are subject to applicable U.S. and foreign export-control, reexport, transfer, sanctions, customs, import-control, antiboycott, transportation, and trade laws. You may not use Boombinere to purchase, receive, store, inspect, consolidate, repackage, return, transport, export, reexport, transfer, or deliver a prohibited or restricted Item or transaction.
Boombinere does not accept or ship:
- any defense article, defense service, technical data, software, component, accessory, attachment, or other Item controlled under the Arms Export Control Act, the International Traffic in Arms Regulations ("ITAR"), or the United States Munitions List ("USML");
- any commodity, software, technology, or Item that requires an export, reexport, transfer, transit, import, customs, or other governmental license, permit, registration, approval, authorization, exemption, or exception;
- any Item or transaction prohibited or restricted under the Export Administration Regulations ("EAR"), regulations administered by the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"), or another applicable law;
- any transaction involving a sanctioned, blocked, denied, debarred, restricted, or prohibited person, entity, government, military, intelligence service, country, territory, vessel, aircraft, Destination, end user, or beneficial owner; or
- any Item intended, directly or indirectly, for a prohibited military, military-intelligence, nuclear, missile, chemical-weapons, biological-weapons, surveillance, terrorism, human-rights-abuse, or other restricted end use.
Boombinere does not apply for export or import licenses, commodity classifications, advisory opinions, registrations, exemptions, exceptions, or other governmental authorizations for customers. Boombinere may require the manufacturer's Export Control Classification Number ("ECCN"), a written EAR99 statement, product specifications, end-use information, end-user information, or independent professional classification before processing an Item.
You represent and warrant that:
- you are the lawful purchaser or owner of every Item, or are legally authorized to act for the lawful purchaser or owner;
- neither you nor any purchaser, seller, recipient, end user, beneficial owner, payment source, or other transaction party is sanctioned, blocked, denied, debarred, prohibited, or restricted;
- no Item will be used, transferred, retransferred, resold, diverted, or delivered to an unauthorized Destination, recipient, end user, or end use;
- each Item is eligible for shipment without a government license, permit, approval, authorization, exemption, exception, or other special permission;
- all information and documents you provide are complete, truthful, current, and accurate; and
- you will not divide, relabel, misdescribe, undervalue, conceal, reroute, or structure a transaction to evade a law, reporting requirement, Carrier rule, or Boombinere policy.
You authorize Boombinere to screen transaction parties and information against government and commercial restricted-party databases. Boombinere may hold, reject, block, report, or refuse a transaction based on an actual or potential match, incomplete information, or compliance concern.
When law requires property to be blocked or frozen, Boombinere may be legally prohibited from returning, transferring, shipping, selling, destroying, or otherwise dealing with that property. Nothing in these Terms requires Boombinere to take an action prohibited by law.
Boombinere's acceptance, description, classification, or prior shipment of an Item does not establish that a later shipment is legal. Legal requirements may depend on the Item, quantity, value, Destination, route, purchaser, recipient, end user, beneficial owner, and intended end use and may change without notice.
10. CUSTOMS INFORMATION, EXPORT FILINGS, AND CUSTOMER AUTHORIZATION
You must provide accurate and complete information for every Item and Shipment, including the true product description, quantity, condition, purchase price, fair value, country of origin, manufacturer, model, recipient, Destination, end user, and intended end use. You must provide invoices, receipts, proof of payment, specifications, permits, and other documents upon request.
You may not request or permit false descriptions, undervaluation, omission of contents, inaccurate country of origin, improper gift designations, splitting to avoid reporting thresholds, or any other false or misleading customs or export statement.
Boombinere may prepare basic descriptions, values, commercial invoices, labels, or electronic filing information using data supplied by you or reasonably available from the Item or seller. You authorize Boombinere to rely on that information. Boombinere may correct obvious errors or request additional information but does not assume a duty to independently verify every declaration.
When an Electronic Export Information filing, power of attorney, written authorization, or other export document is required, you must timely provide all requested information and execute the required authorization. The roles and legal responsibilities of the U.S. principal party in interest, foreign principal party in interest, authorized agent, Carrier, and other parties will be determined by applicable law and the actual transaction structure, not merely by labels used in these Terms.
Boombinere may refuse or delay a Shipment when classification, value, origin, end use, end user, authorization, or documentation is incomplete or uncertain. You are responsible for resulting storage, inspection, return, cancellation, and other charges, except to the extent caused solely by Boombinere's willful misconduct or as otherwise required by law.
11. SHIPMENT REQUESTS, PACKAGING, AND CONSOLIDATION
You may request that Boombinere prepare and tender eligible Items for shipment. A shipment request is final once submitted and may not be canceled or changed after processing begins. Boombinere may attempt to accommodate a change but does not guarantee that a change or cancellation is possible, and additional charges may apply.
Standard packaging generally includes a suitable shipping container, reasonable void fill, and packing tape, as determined by Boombinere. Packaging is selected for ordinary transportation conditions and does not guarantee protection from every impact, vibration, compression, temperature, moisture, inspection, or handling event.
Boombinere may consolidate Items, remove external shipping cartons, repackage Items, split Packages, or select a different carton when requested by you or reasonably necessary for transportation. Carrier dimensional-weight rules may make a larger or irregular Package more expensive even if its actual weight is low.
You must request special packaging, double boxing, fragile-item preparation, moisture protection, or other enhanced handling before the Shipment is processed. Special services are subject to availability and additional fees and do not create a guarantee against damage.
Boombinere may decline to ship an Item in merchant packaging that appears unsafe, damaged, insufficient, or noncompliant. Boombinere may repack it at your expense or require you to provide instructions.
12. MEASUREMENTS, BILLABLE WEIGHT, RATES, AND PAYMENT
Boombinere uses U.S. customary units of measurement. Unless another minimum is shown in your plan or rate schedule, the minimum recorded Item weight is 0.20 pounds and the minimum requested Shipment weight is 1.00 pound.
To account for scale variation and internal protective materials, Boombinere may apply a weight tolerance of up to 0.10 pound to an individual Item weighing more than 0.20 pound. Final charges may be based on the greater of actual weight, dimensional weight, minimum weight, or another Carrier billing method.
Displayed rates and estimates may exclude duties, taxes, remote-area charges, fuel surcharges, security fees, address-correction fees, dimensional adjustments, customs charges, storage, inspections, returns, special handling, Carrier corrections, and other third-party charges. Final charges may differ from estimates.
All amounts are payable in U.S. dollars. You must use a payment method that you own or are expressly authorized to use. Boombinere may require proof of authorization, reject third-party payment methods, place a hold on the Account, or require another payment method.
You authorize Boombinere to charge your submitted payment method for requested Services, adjustments, Carrier corrections, storage, returns, duties or taxes advanced on your behalf, chargeback costs, and other amounts owed under these Terms. Boombinere does not store credit card credentials directly; payment processing is facilitated through secure third-party payment gateway providers. You remain responsible for all unpaid amounts even if an Item is returned, confiscated, abandoned, or destroyed.
Past-due balances may result in suspension, storage charges, refusal to release Items, collection costs, and enforcement of any applicable lien. To the fullest extent permitted by law, you are responsible for reasonable costs of collection, including attorney fees and court costs.
13. CARRIERS, ROUTING, DELIVERY ESTIMATES, AND DELAY
Boombinere may select or use Carriers, routes, airports, brokers, agents, and service levels based on availability, Destination, safety, law, and operational requirements. Boombinere may change a route or service provider without notice when reasonably necessary.
Carriers are independent contractors and may impose their own tariffs, limits, prohibited-item rules, claim procedures, and service conditions. Those rules may apply in addition to these Terms.
Any delivery date, transit time, branch-arrival date, or status update is an estimate only. Shipping speed is not guaranteed. Delays may result from weather, customs, inspections, security, holidays, capacity, routing, inaccurate information, Carrier events, government action, or other causes. No refund or compensation is due solely because delivery occurs later than estimated.
Tracking events may be incomplete, delayed, or inaccurate. A tracking status does not alter the custody rules, claim requirements, or proof requirements in these Terms.
14. DESTINATION AND FORWARDING RESTRICTIONS
For account-security and compliance reasons, Boombinere may restrict changes to the country associated with your Account. A forwarding address may be changed only within the same country originally approved for the Account unless Boombinere completes additional review and expressly approves the change.
A request to change a forwarding address must be submitted through an authenticated Account or from the verified email address associated with the Account and may require identity confirmation.
Forwarding Items to another freight forwarder, reshipper, mail-forwarding service, package consolidator, or similar intermediary in or outside the United States is prohibited unless Boombinere gives prior written approval.
Boombinere may refuse delivery to a hotel, temporary address, high-risk address, restricted region, prohibited party, or address inconsistent with the Account or transaction information.
15. PACKAGE RETURNS AND DOMESTIC FORWARDING
At your request, Boombinere may return an eligible Item to a U.S. seller or send it to another approved U.S. address. The standard return-service fee is $5.00 per return request, plus postage, packaging, Carrier charges, and any additional handling, unless a different fee is shown when you submit the request.
You are responsible for confirming the seller's return authorization, deadline, address, label requirements, restocking fees, and refund terms. Boombinere does not guarantee that the seller will accept the return or issue a refund.
Once a return Package is tendered to a Carrier, any loss or damage claim is subject to the Carrier's rules and the account under which the label was issued. Boombinere will determine whether the Customer, Boombinere, or another party must submit the Carrier claim and may require your cooperation and documents.
International returns are not ordinarily offered. Boombinere may accept an international return only if you provide an approved shipping label, complete export documents, and any required authorization, and Boombinere confirms acceptance in writing.
Returns, domestic forwarding, and disposal requests remain subject to export controls, sanctions, fraud holds, payment requirements, and any legal prohibition on transferring the Item.
16. SPECIAL REQUESTS AND HANDLING INSTRUCTIONS
Available special requests may include removal of shoe boxes or excess packaging, splitting Items, photographs, suite transfers, repacking, and custom handling. Services, fees, and availability may change and may depend on the Item.
Boombinere will use reasonable efforts to follow accepted instructions but may decline, modify, or stop a request that is unclear, unsafe, unlawful, impractical, likely to damage an Item, or inconsistent with Carrier or customs requirements.
Removing, opening, cutting, discarding, separating, or altering original packaging may reduce value, eliminate merchant-return eligibility, expose the Item to damage, remove serial or authenticity information, or affect warranty rights. When you request such handling, you accept those risks.
Boombinere is not liable for ordinary and reasonably foreseeable consequences of accurately following your special request, except for loss or damage caused by Boombinere's gross negligence or willful misconduct where such liability cannot be limited by law.
Default Item preferences stored in your Account apply to future Items until changed. You are responsible for reviewing those preferences and updating them before an Item is processed.
17. STORAGE, FEES, AND UNCLAIMED PROPERTY
Unless a different period is stated in your Account, each Item receives 60 days of free storage beginning on the date it is checked into your suite. Boombinere does not offer automatically renewing subscription plans or recurring membership fees.
After the free-storage period, storage is charged at $0.50 per pound per day for up to 30 additional days, unless a different current rate is shown in your Account or posted rate schedule. Storage charges must be paid before release or shipment.
You must maintain current contact information and monitor your Account. Boombinere may send storage and disposition notices to the email address, telephone number, physical address, or in-app contact method associated with your Account. Electronic notice is effective when sent, unless applicable law requires another method.
Pursuant to Tennessee Code Annotated § 47-7-209 and § 47-7-210, Boombinere claims a statutory warehouse lien on all Items, goods, and proceeds in its possession for all unpaid storage, transportation, preservation, handling, and administrative charges. This lien extends to current and prior unpaid balances associated with your Account.
If an Item remains unclaimed, unpaid, or without valid shipping or return instructions for 90 days after check-in, or for another period required by law, Boombinere may treat it as abandoned and may hold, return, sell, donate, recycle, destroy, surrender, or otherwise dispose of it, subject to legally required notices, statutory lien enforcement procedures, sanctions restrictions, and unclaimed-property laws.
Boombinere may immediately isolate or dispose of leaking, perishable, infested, dangerous, illegal, or valueless property when reasonably necessary to protect persons, property, or legal compliance, with notice when practicable.
You remain responsible for storage, handling, return, remediation, disposal, legal, Carrier, and government costs. If property is sold, any treatment of sale proceeds will be governed by applicable law after deduction of amounts owed and reasonable sale or disposition expenses.
Boombinere's rights under this section are cumulative and do not waive any warehouse lien, contractual lien, security interest, or other remedy available by law.
18. OPTIONAL SHIPMENT PROTECTION (INSURANCE)
Boombinere may offer optional private shipment protection or declared-value coverage, referred to in the Site or Account as "insurance." Coverage is available only for eligible Items and Shipments when you request it, Boombinere accepts it, and the applicable fee is paid before shipment. Items are not automatically insured for full value.
The current fee is 3% of the value you choose to insure. For example, the fee to insure eligible property for $1,000 is $30. Boombinere may impose eligibility rules, per-Item or per-Shipment limits, deductibles, documentation requirements, and exclusions.
The maximum amount payable for an approved claim is the lesser of:
- the value entered for the Item in the customs declaration;
- the amount for which the Item was insured;
- the Item's documented purchase value or actual cash value immediately before the covered loss; or
- any applicable coverage limit.
You must prove value with an invoice, order confirmation, receipt, payment record, or other documentation acceptable to Boombinere. If you declare or insure an Item below its actual value, payment is limited to the lower declared or insured value.
Jewelry and precious stones are subject to a maximum coverage limit of $500 per Shipment unless Boombinere confirms a different limit in writing before shipment. Cash, currency, negotiable instruments, prohibited Items, and Items shipped contrary to these Terms are not covered.
Coverage applies only to physical loss of or direct physical damage to an eligible Item that can reasonably be established as occurring during the covered period. Coverage does not include:
- preexisting damage, concealed damage that cannot be tied to the covered period, manufacturing defects, inherent vice, ordinary wear, corrosion, gradual deterioration, or loss of function without evidence of physical damage;
- inadequate merchant or original packaging before Boombinere's custody;
- loss caused by inaccurate descriptions, undervaluation, prohibited contents, fraud, customer instructions, or failure to disclose dangerous or regulated goods;
- loss, damage, or reduced value resulting from a requested packaging removal, alteration, split, inspection, or other special handling performed with reasonable care;
- government seizure, confiscation, detention, rejection, blocking, forfeiture, destruction, or customs action;
- delay, market loss, sentimental value, loss of use, replacement inconvenience, lost profit, business interruption, data loss, or any indirect or consequential loss; or
- Items abandoned or disposed of under the Storage section.
Boombinere's standard receiving process may photograph only the exterior of an incoming Package. Boombinere does not ordinarily open sealed manufacturer packaging, remove an Item, test it, or inspect concealed contents unless you request an available inspection service or inspection is reasonably necessary.
You are responsible for providing evidence that an Item was received at the Warehouse and was in good condition at that time. Customers shipping fragile, collectible, electronic, high-value, or damage-sensitive Items are strongly encouraged to request incoming inspection photographs. Without such evidence, concealed-damage coverage may be unavailable and the claim may be denied.
When an Item remains sealed and its condition was not documented upon arrival, Boombinere may be unable to determine whether damage existed before arrival, occurred during delivery to Boombinere, resulted from a manufacturing defect, occurred in the Warehouse, or occurred during outbound transportation. The mere discovery of damage at pickup does not establish a covered loss.
Approved claim payments may be conditioned on surrender of the damaged Item, packaging, salvage, or rights against responsible third parties. Upon payment, Boombinere or the coverage provider may acquire salvage and subrogation rights to the extent of the payment.
The specific policy, certificate, or coverage terms issued for a Shipment control if they conflict with this general section. Nothing in these Terms expands coverage beyond the actual insurance or protection arrangement available to Boombinere.
19. CLAIMS, PICKUP INSPECTION, AND ACCEPTANCE
You must inspect each Package and its contents while inside the Boombinere branch and before signing a packing list, electronic receipt, or other acceptance record. Any missing Item, visible damage, concealed damage discovered during inspection, or other discrepancy must be immediately reported to a Boombinere employee and documented before acceptance and departure.
You are responsible for opening and inspecting insured Items at pickup. If you choose not to open or inspect an Item, you accept the risk that a later claim may be denied because the Item's condition at pickup cannot be verified.
Except for a claim reported and documented before acceptance, signing the packing list or other receipt confirms that:
- you received the Package;
- the listed contents were present;
- you had an opportunity to inspect the Package and contents; and
- you accepted the Package and contents in their apparent condition.
Claims for missing or damaged Items reported after the acceptance record is signed or after you leave the branch are automatically denied to the fullest extent permitted by law.
The pickup deadline does not apply to a Shipment that is totally lost and never made available for pickup. A total-loss claim must be reported promptly after you learn of the loss and no later than any deadline stated by Boombinere, the Carrier, or the applicable coverage terms.
Claims are evaluated separately for each Item. You may be required to provide:
- invoice, receipt, or order confirmation;
- proof of payment and ownership;
- customs declaration and shipping records;
- photographs or video taken before and after shipment;
- incoming inspection photographs;
- the Item, original packaging, shipping carton, labels, and packing materials;
- a repair estimate, diagnostic report, or statement that the Item cannot be repaired;
- a police, Carrier, customs, or government report; and
- any other information reasonably necessary to investigate the claim.
You must preserve the Item and all packaging until the investigation is complete. Disposal, alteration, repair, transfer, continued use, or removal of evidence before authorization may result in denial.
An investigation may take up to 21 days after Boombinere receives all requested information and evidence. Additional time may be required for Carrier, insurer, law-enforcement, customs, or third-party review. Submission of documents does not guarantee approval.
A false, exaggerated, staged, duplicated, or materially misleading claim voids coverage and may result in account termination, recovery of investigation costs, and referral to appropriate authorities.
20. DUTIES, TAXES, GOVERNMENT ACTION, AND CONFISCATION
You are responsible for all import duties, customs charges, taxes, assessments, permits, inspections, brokerage, storage, demurrage, fines, and other government or third-party charges related to your Items and Shipments, except for amounts that Boombinere expressly agrees in writing to pay.
Boombinere may collect estimated duties, taxes, or transfer charges for certain electronics, high-value Packages, bulk cargo, or other categories. Any amount collected is an estimate unless expressly stated otherwise. You remain responsible for additional amounts assessed by authorities or service providers.
If you or the recipient refuses delivery or fails to provide customs documents, pay charges, or complete clearance, Boombinere or the Carrier may return, hold, abandon, or dispose of the Package. You are responsible for the resulting costs.
Boombinere is not liable for confiscation, seizure, detention, blocking, rejection, destruction, forfeiture, or delay by Erbil International Airport or any other airport authority, customs authority, port authority, law-enforcement agency, security service, Carrier, or government authority worldwide. Optional shipment protection does not cover these events.
Restricted Items that Boombinere agrees to ship remain at your risk of Destination-country confiscation or inability to move the Item between cities or regions. Acceptance for shipment is not a guarantee of import legality or release.
21. FRAUD, CHARGEBACKS, AND SUSPICIOUS ACTIVITY
Boombinere may hold Items, request proof of purchase, verify a transaction with a merchant or payment provider, suspend an Account, refuse shipment, cancel a request, or take other reasonable action when fraud, theft, unauthorized payment, identity misuse, sanctions evasion, or other unlawful activity is suspected or reported.
You must provide truthful invoices, payment records, identification, and ownership information. Boombinere may retain Items during investigation and may disclose relevant information to merchants, Carriers, payment providers, insurers, law enforcement, customs authorities, and other government agencies.
Filing a chargeback does not cancel amounts validly owed. If a chargeback or payment reversal is submitted for an authorized transaction, you remain responsible for the charge, storage accrued during the dispute, and reasonable costs incurred in responding to the chargeback.
Boombinere may refuse to release or ship Items until payment and ownership disputes are resolved. Items that are stolen, fraudulently purchased, or subject to a lawful claim may be returned or surrendered to the rightful owner or authorities as permitted by law.
22. ACCEPTABLE USE AND USER CONDUCT
You must comply with all applicable local, state, federal, foreign, postal, customs, transportation, privacy, intellectual-property, and trade laws. You may not use the Services to:
- violate or attempt to violate any law, regulation, sanctions restriction, Carrier rule, or these Terms;
- harm, threaten, harass, defraud, impersonate, or mislead Boombinere, another customer, a merchant, a Carrier, or a government authority;
- provide false, inaccurate, incomplete, altered, or misleading information or documents;
- infringe a copyright, trademark, patent, trade secret, privacy right, publicity right, or other right;
- conceal identity, origin, value, contents, ownership, payment source, recipient, Destination, end user, or end use;
- interfere with or disrupt the Site, application, systems, networks, accounts, or security measures;
- upload malware, malicious code, automated scraping tools, or content designed to damage or gain unauthorized access;
- collect, use, or disclose another person's information without authorization; or
- use information obtained through the Services to compete unfairly with, harm, or compromise Boombinere or its customers.
Boombinere may investigate suspected violations and cooperate with affected parties or authorities. Enforcement decisions in one case do not require the same decision in another case.
23. PRIVACY, COOKIES, AND ELECTRONIC COMMUNICATIONS
Boombinere's Privacy Policy governs the collection, use, disclosure, retention, and international transfer of personal information. By using the Services, you acknowledge the Privacy Policy and represent that you have obtained any consent necessary to provide another person's information to Boombinere.
The Site and applications may use cookies, pixels, local storage, analytics, and similar technologies to operate the Services, remember preferences, measure performance, prevent fraud, and improve user experience. Browser or device settings may limit these technologies, but some features may not function properly.
You consent to receive transactional communications electronically, including Account notices, verification requests, receipts, policy updates, storage notices, claim communications, and shipping updates. Electronic records and signatures have the same effect as paper records and handwritten signatures to the fullest extent permitted by law. You are responsible for maintaining a working email address, telephone number, and access to your Account. A communication is effective when sent to the contact information in your Account, unless applicable law requires another method or proof of receipt.
SMS/Text Messaging Consent: If you provide a mobile phone number and opt in to receive text messages from Boombinere, you authorize Boombinere to send transactional SMS messages regarding account notifications, shipment updates, package receipts, security verifications, and customer service alerts. Message and data rates may apply. Message frequency varies depending on your account activity and shipment volume. You may opt out of text messages at any time by replying STOP to any SMS message. For assistance, reply HELP or contact customer support. Mobile phone numbers and SMS opt-in consent information will strictly not be sold, rented, shared, or transferred to any third parties or affiliates for marketing or promotional purposes.
24. WEBSITE, APPLICATION, AND INTELLECTUAL PROPERTY
The Site and applications are provided on an "as is" and "as available" basis. Boombinere may modify, suspend, restrict, or discontinue features, content, interfaces, or access without guaranteeing uninterrupted availability.
Boombinere and its licensors own the Site, applications, software, text, graphics, logos, icons, photographs, databases, compilations, designs, trademarks, service marks, and other content, excluding customer-provided content. Applicable U.S. and international intellectual-property laws protect those materials.
Subject to these Terms, Boombinere grants you a limited, revocable, nonexclusive, nontransferable license to use the Site and applications for your own lawful use of the Services. You may not copy, modify, distribute, sell, sublicense, reverse engineer, scrape, frame, mirror, or commercially exploit the Site or applications except as permitted by law or written authorization.
You grant Boombinere a nonexclusive license to use information, photographs, documents, and content you submit as reasonably necessary to provide the Services, prevent fraud, comply with law, resolve disputes, and enforce these Terms.
25. THIRD-PARTY SERVICES, RETAILERS, AND LINKED SITES
Boombinere may provide links, integrations, rate information, Carrier services, merchant information, and other third-party resources for convenience. Boombinere does not control or endorse third-party content and is not responsible for its accuracy, security, availability, products, or policies.
Some retailers refuse to ship to freight forwarders, reshippers, or commercial receiving addresses. Retailers may include Best Buy, Apple, Sephora, Ulta, Adidas, Lego, and others, and their policies may change. Boombinere does not guarantee that any retailer will accept your order or address.
You are responsible for reviewing and complying with merchant, Carrier, payment-provider, and third-party terms. A third party's refusal, cancellation, suspension, refund decision, or policy change does not create liability for Boombinere.
26. DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." BOOMBINERE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND UNINTERRUPTED AVAILABILITY.
BOOMBINERE DOES NOT WARRANT THAT AN ITEM IS AUTHENTIC, COMPLETE, UNDAMAGED, FUNCTIONAL, LEGAL TO EXPORT OR IMPORT, PROPERLY CLASSIFIED, ACCEPTABLE TO A CARRIER OR GOVERNMENT, OR SUITABLE FOR YOUR PURPOSE. BOOMBINERE DOES NOT GUARANTEE DELIVERY TIMES, CUSTOMS RELEASE, MERCHANT REFUNDS, OR THE OUTCOME OF A CLAIM.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the fullest extent permitted by law, and you may have rights that cannot be waived.
27. LIMITATION OF LIABILITY
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for Boombinere's fraud or willful misconduct where applicable law prohibits limitation.
Subject to the preceding sentence and to the fullest extent permitted by law, Boombinere and its owners, employees, contractors, agents, affiliates, and service providers are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost sales, business interruption, loss of use, lost data, reputational harm, or replacement inconvenience, even if advised that such damages were possible.
Approved claims under Optional Shipment Protection are governed exclusively by Section 18 and the applicable coverage terms. Except for an approved covered claim, Boombinere's aggregate liability for all claims arising from or relating to an uninsured Shipment, Item, or related Services will not exceed the greater of:
- $100; or
- the amount of service fees paid directly to Boombinere for the specific Shipment or transaction giving rise to the claim, excluding postage, duties, taxes, insurance premiums, Carrier charges, and amounts paid to third parties.
Customer expressly acknowledges that the $100 liability limitation is an agreed-upon valuation under Tennessee law and that full declared-value coverage is available through Optional Shipment Protection under Section 18.
The liability limit applies regardless of legal theory, including contract, negligence, bailment, warehouse liability, tort, statute, or otherwise, and regardless of the number of claims, Items, Packages, or parties. It does not increase because Boombinere knew an Item's value unless Optional Shipment Protection was purchased and applies.
Boombinere is not liable for acts or omissions of merchants, Carriers, customs brokers, airlines, airports, government authorities, recipients, or other third parties, except to the extent Boombinere is legally responsible and the liability cannot be limited.
The limitations in these Terms are a material part of the pricing and allocation of risk. The Services would not be offered on the same terms without them.
28. INDEMNIFICATION
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Boombinere and its owners, employees, contractors, agents, affiliates, Carriers, and service providers from claims, investigations, seizures, liabilities, judgments, losses, fines, penalties, damages, costs, and expenses, including reasonable attorney fees, arising from or relating to:
- your Item, Shipment, Account, instructions, acts, omissions, or violation of these Terms;
- inaccurate, incomplete, false, or misleading information, documents, descriptions, values, classifications, origins, Destinations, end users, or end uses;
- a prohibited, restricted, dangerous, stolen, counterfeit, or unlawfully purchased Item;
- a customs, export-control, sanctions, import, hazardous-materials, postal, privacy, intellectual-property, tax, or transportation violation;
- an unauthorized payment, chargeback, ownership dispute, merchant dispute, or third-party claim;
- government confiscation, seizure, detention, blocking, forfeiture, or destruction attributable to your Item or transaction; or
- your failure to inspect a Package, report a claim, preserve evidence, pay charges, or maintain accurate contact information.
Boombinere may control the defense and settlement of an indemnified matter, and you must reasonably cooperate. Boombinere will not agree to a settlement that imposes a personal admission or nonmonetary obligation on you without your consent, which will not be unreasonably withheld.
29. SUSPENSION, TERMINATION, AND ACCOUNT CLOSURE
You may request Account closure after all Shipments, Items, disputes, and balances are resolved. Closing an Account does not cancel accrued charges or provisions that survive termination.
Boombinere may limit, suspend, or terminate an Account or Service immediately, with or without prior notice, for nonpayment, inactivity, fraud, security concerns, legal or compliance risk, prohibited Items, abusive conduct, inaccurate information, operational reasons, or violation of these Terms.
After suspension or termination, Boombinere may refuse new deliveries and require you to provide lawful return, shipment, or disposition instructions within a stated period. Release remains subject to payment, verification, sanctions, legal holds, and applicable law.
Boombinere is not liable for loss resulting solely from a lawful suspension or termination. Sections concerning payment, storage, claims, export compliance, ownership, intellectual property, disclaimers, liability, indemnification, dispute resolution, and general contract terms survive.
30. FORCE MAJEURE
Boombinere is excused from delay or failure to perform caused by events beyond its reasonable control, including natural disasters, fire, flood, severe weather, epidemic, pandemic, war, terrorism, civil disturbance, riot, labor dispute, transportation interruption, airport or border closure, Carrier embargo, customs action, government order, sanctions change, utility failure, communications outage, cyberattack, system failure, supply shortage, or other force majeure event.
During a force majeure event, Boombinere may suspend, reroute, store, delay, or cancel affected Services. You remain responsible for charges reasonably incurred to protect, store, return, or dispose of Items.
31. CHANGES TO THE SERVICES AND THESE TERMS
Boombinere may change rates, eligibility, operating procedures, prohibited-item rules, service features, and these Terms. Material changes will be posted on the Site or communicated through the Account, email, or another reasonable method before they take effect, except that immediate changes may be made when reasonably necessary for law, safety, fraud prevention, security, Carrier requirements, or government action.
The version in effect when you submit a shipment request generally governs that Shipment, except for changes required by law or third-party rules. Continued use of the Services after a change becomes effective constitutes acceptance of the revised Terms.
If you do not agree to a change, you must stop using the Services and arrange lawful disposition of Items already held, subject to outstanding charges and these Terms.
32. NOTICES
Notices from Boombinere may be delivered by posting to the Site or Account, email, text message, telephone, physical mail, or in-person communication. You consent to electronic notices and must keep your contact information current.
Formal legal notices to Boombinere must be sent by nationally recognized overnight courier or certified U.S. mail, return receipt requested, to: Boombinere LLC, 2410 Cruzen Street, Nashville, Tennessee 37211, with a copy by email to info@boombinere.com. An email alone is not formal legal notice unless Boombinere acknowledges it in writing.
Operational questions, shipment instructions, and customer-support messages should be submitted through the Site, application, or ordinary support channels rather than the formal legal-notice procedure.
33. GOVERNING LAW, BINDING ARBITRATION, AND TIME TO BRING CLAIMS
These Terms and any dispute arising from or relating to the Services are governed by the laws of the State of Tennessee and the Federal Arbitration Act (FAA), 9 U.S.C. § 1 et seq., without regard to conflict-of-law principles.
Before initiating arbitration or formal legal proceedings, you and Boombinere agree to attempt in good faith to resolve any dispute informally. The complaining party must provide written notice describing the nature and facts of the dispute and the requested resolution and allow at least 30 days for informal negotiation. Formal written notices to Boombinere must be sent by certified mail to 2410 Cruzen Street, Nashville, TN 37211, or by email to info@boombinere.com.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services that is not resolved through the 30-day informal dispute resolution process shall be resolved exclusively through final and binding individual arbitration under the FAA, administered by the American Arbitration Association ("AAA") under its applicable Commercial or Consumer Arbitration Rules, rather than in court. Venue for any arbitration proceedings shall be in Davidson County, Tennessee, or conducted virtually upon mutual agreement. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
YOU AND BOOMBINERE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MULTIPLE PERSONS AND MAY NOT PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. YOU AND BOOMBINERE EXPRESSLY WAIVE ANY RIGHT TO A TRIAL BY JURY. IF ANY PORTION OF THIS ARBITRATION PROVISION IS DEEMED INVALID OR UNENFORCEABLE, THAT SPECIFIC PORTION SHALL BE SEVERED, AND THE REMAINING ARBITRATION PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.
To the fullest extent permitted by law, any arbitration, claim, or legal action against Boombinere must be filed within one year after the event giving rise to the claim or the date the claimant reasonably should have discovered it, whichever is later. A shorter Carrier, customs, coverage, or pickup claim deadline remains applicable when stated in these Terms or governing documents.
34. GENERAL CONTRACT TERMS
Entire Agreement. These Terms, incorporated policies, posted rates, applicable Carrier terms, and any signed written agreement constitute the entire agreement concerning the Services and supersede prior or contemporaneous discussions and representations about the same subject.
Assignment. You may not assign, transfer, delegate, or sublicense your rights or obligations without Boombinere's prior written consent. Boombinere may assign these Terms in connection with a merger, sale, reorganization, financing, or transfer of all or part of its business or assets.
Severability. If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent or modified as necessary to make it enforceable, and the remaining provisions will remain in effect.
No Waiver. A failure or delay in enforcing a provision is not a waiver. A waiver applies only to the specific instance and must be in writing by an authorized Boombinere representative.
No Agency. These Terms do not create a partnership, joint venture, franchise, employment, fiduciary, or agency relationship, except that a specific written authorization may appoint Boombinere or another party as an agent for a limited filing or transaction purpose.
No Third-Party Beneficiaries. Except for persons expressly protected by the disclaimers, liability limitations, and indemnification provisions, these Terms do not create rights for third parties.
Headings and Construction. Headings are for convenience only. "Including" means "including without limitation." Singular terms include the plural and vice versa where the context permits. These Terms will not be construed against either party merely because that party drafted them.
Language. Any translation is provided for convenience. The English-language version controls to the extent permitted by law if there is a conflict or ambiguity.
Survival. Provisions that by their nature should survive termination remain effective, including payment, storage, claims, compliance, ownership, intellectual property, disclaimers, liability limitations, indemnification, governing law, and general contract terms.
